The sole purpose of these General Conditions of Sale is to contractualize the sales of products offered on the site www.najel.net (hereinafter referred to as "the Najel store") between the buyer (hereinafter referred to as "the customer") and the seller (hereinafter referred to as "Laboratoire NAJJAR").

They are accessible at any time on this site by the buyer and also at the time of registration of the order. At any time, the buyer has the possibility to consult on the Najel site the description of each of the products to know its characteristics. Consequently, the fact of placing an order implies the buyer's adherence to these General Conditions of Sale.

The sale of our products in the Najel store is exclusively reserved for the final consumer, that is to say, any natural person not acting as a trader. Thus, orders from professionals on the Najel store will not be honored by the company Laboratoire NAJJAR.

Laboratoire NAJJAR reserves the right to cancel any order of an abnormal nature, such as an order for quantities of products exceeding the normal needs of a consumer or abnormal order flows to the same billing and/or delivery address.

Laboratoire NAJJAR strives to ensure, to the best of its ability, the accuracy and updating of the elements published on this site, and we reserve the right to correct its content at any time.

Despite the care taken in collecting information, errors, omissions or inaccuracies may exist. Laboratoire NAJJAR declines all responsibility in the event of damage, direct or indirect, of any nature whatsoever, resulting in whole or in part from the use of the site. ARTICLE 2. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

These general terms and conditions of sale apply to all commercial relations concluded through the website, the Najel store between the author of the order and the Laboratoire NAJJAR Company.
The general conditions of sale are accessible on this site of the Najel store by the customer at the time of ordering, which may be subject to modification at any time by the Laboratoire NAJJAR Company. This is the reason why users are invited to consult them regularly.

Placing an order on the Najel store implies full and unreserved acceptance of the general conditions of sale of the Laboratoire NAJJAR Company as well as the loyalty program, the conditions of which are detailed in article 19 of these General Conditions of Sale.

No special condition may, unless formally accepted in writing by Laboratoire NAJJAR, prevail over these general conditions. Any contrary condition opposed by the customer will therefore, in the absence of express acceptance, be unenforceable against Laboratoire NAJJAR, regardless of when it may have been brought to its attention.

ARTICLE 3. ORDER AND VALIDATION

The customer can browse and learn about the different products offered for sale by Laboratoire NAJJAR in the Najel store, without any commitment to purchase.

The customer selects the item(s) of their choice and adds them to the shopping cart; the customer can at any time obtain a summary of the products they have selected by clicking on the shopping cart, the corresponding prices and make any necessary changes. The customer is also informed at any time of the amount or free shipping costs in France by clicking on their shopping cart.

ORDER

To order the products he has chosen, the customer clicks on the button " order » appearing on the basket. To order, the customer will have to identify himself to access his customer account.

The customer is then invited to enter or choose their delivery and billing address.

After validating their delivery and billing addresses, the customer is informed of the amount or free shipping costs.

The customer confirms his/her acceptance of the general terms and conditions of sale, which he/she may read or reread, by checking the box provided.

Then, the customer chooses his method of payment to pay for his order either by Paypal account, or by credit card, or by bank transfer. Orders are only payable in euros. By selecting the payment method by Paypal, the customer is then automatically switched to the electronic payment server of the secure payment platform Paypal. By selecting the payment method by credit card, the customer is then automatically switched to the electronic payment server of the secure payment platform Stripe.

As long as the payment of the order has not been validated by the customer, the latter still has the possibility of returning to the summary of his order for any modification or addition of promotional code by clicking on the "Basket" button.

After validation of the Paypal or credit card payment or after validation of payment by bank transfer, the order is validated and recorded.

A detailed acknowledgment of receipt of the order is sent to the customer's email address. This acknowledgment summarizes all the elements constituting the order, including the exact amount invoiced and the terms of delivery of the order.

Tracking of past orders is also available in your customer area in “ My orders ".

The modification of an order is no longer possible once the payment or payment method is validated by the user. For any request to cancel an order that has not yet been shipped, the user can contact Laboratoire NAJJAR by e-mail or telephone.

The order is processed upon receipt of payment. If payment is not made within 15 days of the order being registered, the order will be cancelled.

However, Laboratoire NAJJAR reserves the right to cancel any order from a customer with whom there is a payment arrears or a dispute relating to the payment of a previous order, or for any other legitimate reason, particularly due to the abnormal nature of the order.

In accordance with Article 10 mentioned below, the customer has a right of withdrawal and reimbursement, for a period of fourteen (14) working days from the date of receipt of the products by the customer.

ARTICLE 4. AVAILABILITY OF PRODUCTS

The product offers proposed on the Najel store are only valid while stocks last. Laboratoire NAJJAR reserves the right not to renew certain products.

If one of the products is unavailable after the order has been placed, the customer will be informed as soon as possible by email or telephone, as well as the delivery time or cancellation of the order.
The customer will then have the choice of requesting either a refund of the amounts paid by bank transfer or via PayPal or an exchange of the product.

The photographs and texts illustrating the products are not part of the contractual field. The articles and/or packaging may undergo changes in presentation.

ARTICLE 5. PRICE

The prices on this site are indicated in Euros, are subject to change during the year and are valid for the territories of the European Union excluding DOM and TOM. They take into account any reductions as well as French VAT, applicable on the day of the order.

Any order placed on the Najel store and delivered outside the European Union and to the French Overseas Territories may be subject to possible taxes, customs duties and other related fees that are imposed when the package reaches its destination. These additional fees are the responsibility of the Customer.

The prices indicated on the Najel store are guaranteed on the day of the order within the limit of available stocks, and except for obvious typographical errors or omissions.

Promotional offers are only valid for the duration of the validity of the offer in question.

The prices indicated do not include shipping costs which will be charged in addition or offered depending on the amount of the order and the country of delivery; they are specified to the customer throughout their order by clicking on the order basket and when confirming it.

These shipping costs do not include customs and other additional costs that may be requested upon entry to certain countries; these costs remain the exclusive responsibility of the customer.

Laboratoire NAJJAR reserves the right, which the customer accepts, to modify its prices at any time.

The products remain the full property of Laboratoire NAJJAR until the price has been fully collected by Laboratoire NAJJAR. Retention of title: the transfer of ownership is subject to full payment of the price (law n°85-98 of 25.01.1985). At no time may the sums paid be considered as deposits or down payments.

Furthermore, Laboratoire NAJJAR has a loyalty program, the conditions of which are detailed in article 19.

ARTICLE 6. SHIPPING COSTS

For customers whose delivery address is outside France, the shipping costs correspond to the postage costs depending on the chosen carrier. These are calculated based on the weight, volume of the items (up to 30 kg) and the destination. The delivery services available for international shipping include Chronopost Express, Colissimo and FedEx .

ARTICLE 7. PAYMENT AND SECURITY

Payment for purchases in the Najel store is made exclusively in euros.

The total amount of the order is payable online when placing the order, by credit card or Paypal account, or by bank transfer to the account of Laboratoire NAJJAR.

The bank cards accepted are: CB, Maestro, Visa and Master Card.

Online payments on our site are made via the Paypal or Stripe platform, in order to ensure optimal security and confidentiality for the customer.

In case of refusal by the payment center, the order will be cancelled and the customer informed by email or telephone.

In the event of payment by bank transfer and in the absence of payment within 15 days following registration of the order, the latter will be cancelled.

Customers guarantee that they are fully authorized to use the bank card and that this bank card provides access to sufficient funds to cover all costs resulting from the use of the services of the Najel store.

ARTICLE 8. SHIPPING AND DELIVERY

SHIPPING : Orders are processed as quickly as possible by Laboratoire NAJJAR upon receipt of payment. Payment by credit card or Paypal guarantees the speed of order processing. Laboratoire NAJJAR is open from Monday to Friday inclusive, excluding annual summer or winter closures for which the customer will be informed on the home page of our site. Sales and prices are ex-works from Civrieux 01390 (Ain) in France.

Laboratoire NAJJAR undertakes to ship your order as quickly as possible and within a maximum of 30 days following receipt of your payment.
An email is sent to the customer as soon as the order is shipped. The customer then has the possibility to track the delivery of their package by logging into their account.

DELIVERY : The products are delivered in accordance with the information indicated on the Najel store. It is the customer's responsibility to provide all the details necessary for the proper delivery of their order by attaching, if possible, the telephone number and email of the recipient, as well as any useful information (digital codes, building, floor, staircase, etc.).

For any delivery address located in mainland France (including Corsica) , Laboratoire NAJJAR offers several delivery methods:

  • Delivery to a relay point : via Mondial Relay or Colis Privé , allowing the customer to collect their package from the selected relay point.
  • Home delivery : via Colissimo, Chronopost Express or FedEx , depending on the customer's choice.

Delivery times vary depending on the carrier selected and are generally between 48H and 72H for mainland France. These times are in working days, excluding delivery problems.

For any delivery address located outside metropolitan France , Laboratoire NAJJAR offers the services of Colissimo, Chronopost Express and FedEx . Delivery times vary depending on the destination.

In the event of absence, the customer will have the possibility, within 15 days from the date indicated on the notice left in your mailbox by the postman, to collect their parcel from the post office closest to their delivery address.

Laboratoire NAJJAR undertakes to do everything possible to enable the delivery of the package by Colissimo as quickly as possible.

DELAY | LACK OF DELIVERY: e In the event of a delivery delay of more than 7 days from the date of dispatch or if the package is lost, Laboratoire NAJJAR asks the customer to report it as soon as possible in order to initiate an investigation with the carrier concerned ( Colissimo, Chronopost Express, FedEx, Mondial Relay or Colis Privé ).

If the product is not found at the end of the investigation (which can last up to 21 days from its opening with the department concerned), the package will be considered lost by the carrier. In this case, Laboratoire NAJJAR may resend the package to the customer, subject to product availability.

If the lost product(s) were no longer available at that time, Laboratoire NAJJAR would reimburse the customer for the amount of these products.

For the Colissimo Access (delivered without signature) no claim can be taken into account if the package is considered to have been delivered by post on the Colissimo site.

Laboratoire NAJJAR declines all responsibility for the extension of delivery times due to the carrier. Delivery delays cannot give rise to damages.

In the event of force majeure*, the sale may then be cancelled and the purchaser may obtain a refund of the amount paid, excluding any other compensation or damages.
Delivery on time can only take place if the buyer is up to date with his obligations towards the seller.
For items unavailable on the date of the order, we offer you a delivery time subject to your acceptance.

* The following are considered to be cases of force majeure releasing the seller from his obligation to deliver: war, riot, fire, strikes, accidents and the impossibility of obtaining supplies. The seller will keep the buyer informed in a timely manner of the cases or events listed above.

ARTICLE 9. RECEIPT OF THE ORDER

The customer is required to check the condition of the package upon delivery and to report any anomaly concerning the delivery ( damage, open package, damaged package, broken products, etc. ) to the carrier by issuing handwritten and signed reservations on the delivery note.

The customer must also immediately report the anomaly to Laboratoire NAJJAR within 7 days , so that a complaint can be made to the carrier concerned ( Colissimo, Chronopost Express, FedEx, Mondial Relay or Colis Privé ).

If the claim is validated, Laboratoire NAJJAR will return the replacement product(s) to the customer at its own expense.

This verification is deemed to have been carried out when the buyer or a person authorized by him has signed the delivery note presented by the delivery person.

ARTICLE 10. RIGHT OF WITHDRAWAL

CONDITIONS: in accordance with the provisions of article L.121-21 of the Consumer Code, the customer has a withdrawal period of 14 days from receipt of the entire order to exercise his right of withdrawal without having to provide reasons or pay a penalty.

To exercise the right of withdrawal, the customer must notify his decision to withdraw from his order by an unambiguous written declaration specifying his first and last name, e-mail, address, order number and date:

RETURN OF PRODUCTS: the customer must return the products no later than fourteen (14) days after communicating his decision to withdraw. Returned products must be unopened, complete and undamaged: returns must be made in their original condition and complete (packaging, accessories, instructions).

In this context, the customer is liable. Any damage suffered by the product on this occasion may be such as to invalidate the right of withdrawal: damaged, opened, soiled, used, incomplete or damaged products will not be accepted.

The customer is responsible for the cost of returning the complete order or products.

REFUND: in the event of exercising the right of withdrawal on the entirety of the order, Laboratoire NAJJAR will reimburse the sums paid by the customer, within 14 days from the day on which Laboratoire NAJJAR is informed of the customer's decision to withdraw.

In the event of withdrawal by the Customer on part of the products in the order, Laboratoire NAJJAR will reimburse the amount of the returned products.

The refund will be made via the same payment method used when ordering.

Laboratoire NAJJAR may defer this reimbursement until receipt and verification of the products.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL: in accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

• the supply of goods liable to deteriorate or expire rapidly.

• the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for obvious reasons of hygiene or health protection.

ARTICLE 11. QUALITY GUARANTEE

The customer benefits from the legal guarantee of hidden defects on the products delivered. If the defect is proven, Laboratoire NAJJAR undertakes to exchange or refund defective or non-compliant products within fourteen (14) days. For any questions about a product or any complaint, the customer can contact Laboratoire NAJJAR by e-mail or telephone.

ARTICLE 12. LIABILITY

The products offered on this site comply with current French legislation.

Laboratoire NAJJAR reminds that in application of article 1124 of the Civil Code, unemancipated minors are incapable of contracting. Consequently, orders intended for minors must be placed by parental authority. In the event of accidental collection of personal data relating to a minor, parental authority has the capacity to oppose their retention and/or transmission to third parties.

The new general terms and conditions of sale will, where applicable, be brought to the attention of the customer by online modification and will only apply to sales made after the modification.

ARTICLE 17. NAJEL LOYALTY PROGRAM

The sale of our products in the Najel store is exclusively reserved for the final consumer, that is to say, any natural person not acting as a trader. Thus, orders from professionals on the Najel store will not be honored by the company Laboratoire NAJJAR as well as the loyalty program whose conditions are detailed below.

PURPOSE: customer loyalty is rewarded; based on purchases made in the Najel store, the customer earns points and benefits from vouchers.

SUBSCRIPTION: Individual customers of the Najel store automatically become members of the Najel loyalty program upon validation of their customer account, with the exception of professionals. Each point and voucher acquired within the framework of the Najel loyalty program are strictly personal. They have no market value and cannot give rise to any compensation or reimbursement.

FUNCTIONING : For each order placed on the Najel store, the customer earns 2 points for every €1 spent. The customer accumulates points that he can then convert into a voucher from his account and thus obtain a code that will allow him to deduct his voucher during his next order. The vouchers available are:

  • 50 pts = 5% discount
  • 100 pts = 10% discount
  • 200 pts = 20% discount
  • 1000 pts = 50€

Points are validated and available in the customer's account, once the status is noted "Complete" on the order. Points are canceled in the event an order is canceled.

The customer can consult these loyalty points and discount vouchers in their account at any time.

MODIFICATION | STOP: Laboratoire NAJJAR is free to modify the terms of its loyalty program at any time, which is why the customer is invited to regularly consult the conditions of said program available on the Najel store.

The Najel loyalty program aims to reward the loyalty of customers of the Najel boutique site, therefore any inappropriate, disrespectful, fraudulent or abnormal use of this program may result in its suspension or deactivation.

In the event of suspension or deactivation, the company Laboratoire NAJJAR will inform the customer by email or telephone.

Laboratoire NAJJAR declines all responsibility for any malfunctions of the Najel loyalty program.
